Madeira administers a national registration system for
pleasure yachts and ships. It is administered by the International Shipping Register of Madeira (MAR). Madeira registered yachts fly the Portuguese flag.
Madeira, officially known as the Autonomous Region of Madeira,
is a dependency of Portugal. The island is an archipelago of the North Atlantic, located in an
area known as Micronesia. The official language of Madeira is Portuguese.
Registration Office
The yacht registry is administered by Sociedade de Desenvolvimento
da Madeira, S.A., a private operated company that has the full support of the Autonomous Region
of Madeira, Portugal. It is committed to providing international companies, and those who work
within them, with the finest standards in the European Community.
Registration Requirements
Commercial and pleasure yachts must measure in length
equal to or greater than 7 meters.
Any individual or entity can register vessels with MAR. There are no nationality requirements for owners of MAR registered vessels. Entities can be
companies,
branches or corporate representations, which may or may not be operating within the scope of the MIBC. Entities not operating within the
framework of the MIBC have to appoint a local legal representative with the necessary powers to ensure full representation before the State and
Regional Authorities. Yacht owners are not required to have their head office in Madeira
as it is sufficient to have local legal representation with adequate powers.
Recording Methods
The Madeira yacht registry offers a flexible mortgage system which allows the mortgagor and the mortgagee, by written agreement,
to choose the legal system of a particular country that will govern the terms of the mortgage.
